Can I check that the agency's negotiator is authorised to have me sign a mandate?

Authorization of the negotiator to sign the mandate

Yes. The employee authorized by a real estate agent to negotiate or engage on his behalf holds a certificate of employment, established by the real estate agent. This certificate of employment is approved by the Chamber of Commerce and Industry (by the prefecture until 1 July 2015), which verifies beforehand that the negotiator meets the same conditions of good repute as a real estate agent.

The certificate is a white cardboard document, on which are indicated the powers entrusted to the negotiator, for example: establish a mandate, a compromise, receive funds ...

The employee of the real estate agent must present his certificate of authorization, at the request of any interested person.

The employee of the real estate agent thus authorized indicates his name on the deed he draws up.

Attention : the commercial agent who works on behalf of a real estate agent has the power to establish mandates if the real estate agent has authorized it. The regulations, on the other hand, prohibit him from giving legal advice, drafting any other contract, such as a compromise, or receiving funds.

Good to know

The real estate agent, holder of the professional card, may delegate to the salaried negotiator that he has authorized for the purpose of negotiating, intermitting or committing on his behalf, the power to accept and sign the written mandate prior to his intervention in any real estate transaction required by article 6-I of the law.
