Co-ownership and state of division
When a property is subject to the co-ownership regime, the co-ownership by-law contains the rules that apply within the co-ownership : it determines the rights and obligations of the co-owners.
It contains:
• The definition of private portions and common portions ,
• The use that the co-owner can make of the private portions, and the common portions ,
• The functioning of the meetings of co-owners,
• The distribution of condominium fees ,
• Possibly, the rules of operation of the co-ownership, and the sanctions if the co-ownership regulations are not respected.
The descriptive statement of division is generally annexed to the co-ownership regulations. It identifies the building, details the numbering of the lots, and the situation of each lot.

If one of the co-owners does not comply with this regulation, the syndic may send him, by registered letter with acknowledgment of receipt, a formal notice. In the event of a "manifestly unlawful disturbance", and if he refuses to comply with the regulations, the co-owner may be summoned by the co-ownership, represented by his syndic, before the judicial court.
