I consider that this product has a hidden defect. However, article 1641 of the Civil Code obliges the seller to guarantee the property sold because of hidden defects that make it unfit for its normal use.

Any buyer of a property who discovers after the purchase a problem that was not apparent has an action against his seller : this is the action in guarantee of hidden defects. Even if buying a property nowadays, in the old one has become less risky thanks to the many diagnoses to which sellers are bound. But it still happens that the buyer makes bad discoveries.
